Improving Digital Sex Crime Response System in South Korea

Abstract

   This study analyzed the previous studies and current status of digital sexual crime, examined the domestic and international response system and proposed improvement plans based on the opinions of experts. The results showed that the definition and scope of digital sex crimes is very broad and diverse, and despite the efforts of law enforcement agencies, digital sex crimes have increased, and the lack of resources has limited the operation of victim support systems. Regarding the domestic response system to digital sexual crimes, the Ministry of Gender Equality and Family is the lead ministry in Korea, the National Police Agency is in charge of investigations, and the Korea Communications Standards Commission deliberates on illegal filming and requests for deletion and blocking, so the response to digital sexual crimes is carried out through multi-agency cooperation. In addition, Seoul Special Metropolitan City, Gyeonggi Province, Incheon Metropolitan City, and Busan Metropolitan City operate their own one-stop victim support centers, while other local governments provide victim support services through the Ministry of Gender Equality and Family, resulting in differences in service provision by region. Meanwhile, the United States, the United Kingdom and EU have established a strategy for child protection and response to violent crimes against women as part of their national strategies, and have established a response system involving various stakeholders such as the governments, private companies, civil society organizations, and academia to strengthen public-private cooperation. In terms of international cooperation, there were a number of international cooperation platforms related to digital sexual offenses, including the Virtual Global Taskforce, Interpol, the Global Partnership for Action on Gender-Based Online Harassment and Abuse, ECPAT International, and the International Association of Internet Hotlines. Based on the results and experts’ opinions, this study suggests the establishment of a control tower in the Prime Minister’s Office as a joint ministerial body when the Ministry of Gender Equality and Family is abolished, the establishment of a digital sexual crime convergence research center as an affiliate of a national research institute, the strengthening of training for digital sexual crime response workers, and the reorganization of the victim support system with a clear division of roles between the central and local governments.
