China's Judicial Reform and its Implications

Abstract

The aim of this research is to study about the Judicial Reform of China for the mutual development between Korea and China.
The Judicial Reform in Korea has been based on the power structure and theoretical background from the separation of the three powers, but there have been some side effects from the cultural causes and human relations in the process of Korean Judicial Reform.
There have been many attempts for the Judicial Reform in China like the establishment of the Judicial Accountability System, the expansion of the disclosure of the Judicial System, the improvement of the Judicial uation System and the reformation of the Judicial supervision.
The problems in the Korean Judicial Reform are the cultural phenomenon that can be granted the privileges of one’s former post in Court and Prosecution, non-disclosure of some written judgment and uation system in the judicature for the general public, the deficiency of mutual control mechanism including reciprocal supervision among criminal justice organizations.
Even though two countries have different power structure, dissimilar form of Government and the ruling party, the Chinese Judicial Reformation can be a good reference for Korean Judicial Reform due to the similar or common cultural background in Asia.
The chinese judicial reformation is just at an early stage for the full implementation, only six regions are the piloted area for the Chinese Judicial Reformation, but the Judicial Reformation in China and Korea is common interest and cooperative task for the local community in Asia.
