Abstract

In "Crime Victims Protection Act" implemented from 2005, the Minister of Justice is to enforce and establish a Basic Plan for Crime Victim Protection and Support every five years, in accordance with the Basic Plan for Crime Victim Protection and Support, the Minister of Justice, Section of relevant central administrative authorities(Police Agency, Women and Family Affairs, Ministry of Health and Welfare, Ministry of Labour, Ministry of Construction and Transportation, etc.) and municipal mayors are required to establish and implement Annual Action Plans.
According to this legislation, the Basic Plan for Crime Victim was established in December 2006, it was conducted from 2007 to 2011. Currently, the Second Basic Plan for Crime Victim Protection and Support is being shut down in 2016 started in 2012 are being implemented. In accordance with “Crime Victims Protection Act” and the Decree, the Third Basic Plan for Crime Victim Protection and Support (2017-2021) is due to be finalized by September 2016, it is reached the time to rush to the preparatory steps for creating the third Basic Plan.
The Basic Plan for Crime Victim Protection and Support is not only a symbolic tool to affirm the country's responsibility for the crime victim, but also a blueprint to guide the protection and support policies for victims of crime over the next five years.
The third Basic Plan for Crime Victim Protection and Support to the full this role, The Ministry of Justice is necessary to assess the performance and limitations of the basic plan for the first and second crime victims, to analyze the changes in the social environment and crime victims reality and to predict the future environment that affect the policy implementation. Based on these results, the Ministry of Justice must derive a long term policy direction, major policy issues, and implementation strategies of the Third Basic Plan for Crime Victims.
At this point, this study was carried out for the purpose of presenting a long term policy direction and major policy issue to be included in the Third Basic Plan for Crime Victims and seeking an effective promotion strategy of the basic plan and annual action plan.
In order to achieve this research, in the present study it may include the following:
First, this study compared the operating system of The Basic Plan for Crime Victim Protection and Support and thats of the Women Basic Plan, the Youth Basic Plan, the Multicultural Family Basic Plan, the Foreigner Basic Plan, Polices Basic Plan. Compare to: 1) the making process of Basic Plan, 2) the structure and contents of the Plan, 3) the making process of Annual Action Plan, and 4) uation and feedback system of Annual Action plans. Through this process of comparative analysis, the present study critically examined the established procedures and the operating system of the first and second Basic Plan for Crime Victim and derived improvement measures.
Second, this study analyzed policy goals and policy issues of the First and The second Basic Plan for Crime victims in terms of 1) whether the long-term perspective of reflection, 2) clarity of policy objectives, 3) between the top policy issue and sub-tasks linkage. 4) between Basic Plan and Annual Action Plan linkage, 5) clarity of the subject and the target. Through this process, the study was derived by improving ways to increase the contents validity of the policy issues.
Third, this study uated the performance outcomes by implementing policy measures included in the First and Second Basic Plan and Annual Action Plan.
Fourth, this study analyzed last 10 years occurrence trends of violent crime and crimes targeting to the social vulnerable and the satisfaction of the victim for the civilian victim support workers and crime victim protection and support policies. Also this study analyzed needs for supporting victim of crime.
Fifth, the present study included to diagnose the problem of the country's crime victim protection and support policies by analyzing a wide range of statistics and reviewing academic papers and policy papers relating to crime and crime victim protection and support policies published after 2011.
Finally, comprehensively reflect the information discussed above, this study proposed a propulsion direction of the main policy issues (draft) and the operating strategy of the Third Basic Plan for Crime Victims.
