Abstract

In modern society the purpose of imprisonment of criminal is to correct, educate and return them to the society. The treatment of prisoners today means treating, improving and educating them not to commit crimes again and promoting social rehabilitation. rather than punishing them. The Open Treatment as a new treatment system has been developed in advanced states and also in Korea for the purpose of removing the harmful effects from the closed treatment in detention facilities and re-socializing the criminals.
This paper examines and reviews the operation and management of the open treatment systems of Cheonan Open Prison, the house of hope for five prisons, Asan and Milyang Hope Center to find out how to improve the open treatment systems adopted in Korea. We interviewed those subject to open treatment, correctional staff, and employees of businesses and employees of companies subject to open treatment in depth and compared and analyzed the open treatment system and operation status of major advanced countries. Based on these studies, we suggest the following improvement plans for each open treatment system, facility, and types.

1. The Improvement of Open Treatment System

In order to improve the open treatment system, the basic concept and intentions of the social adaption capability of prisoners and promoting social return need to be secured, and the open treatment policy should be established and operated accordingly.
It is desirable to install additional open prisons for each local calibration office and to make the capacity of each facility smaller for the purpose of rehabilitation. In addition, introducing the different systematic steps like pyramid and diversifying the open treatments to enhance rehabilitation will and self-reliance of the prisoners.
It is necessary to expand virtual educations and programs essential to daily life after returning to society, such as banking, economic and credit management, and offices for maintaining and recovering family relationships, opening bank accounts, using credit cards, and to offer opportunities to work in government offices. It is desirable to expand opportunities for vocational training and certification.
The works of the prisoners in open treatment facilities need to be performed systematically and professionally at the level of regional correctional and correctional headquarters in order to develop the workforce and to prepare for the similar jobs of the prisoners. The profit distribution ratio of the prisoner of the open facilities need to be higher so that the eligible people might raise funds for stable social settlement after being released from prison. Also, we suggest to specify the appropriate working environment and obligation to provide work expenses when entering into a contract with a recipient employment business. Those who are scheduled to be released to parole need to commute without correctional staffs and to have eight hours of work per day.
Concerning the expansion of social experience opportunities of the open facility prisoners, they need to be provided more frequent opportunities and longer terms of the temporary release to strengthen the family ties and effective adjustment ability to society. They need to experience to expend their own money to use social facilities. They also need to have chances to feel self-esteem through the activities to help other people in society even though they are prisoners, which might prepared and provided by the local governments cooperated with the correctional facilities.
Considered the aim of the open treatment, we need to improve the time length and arrangement of family reunion programs and use of the family visit facilities. They need to use video access, smart phone access, and use of phones to maintain and recover family relationships. That includes computers and the internet in open treatment facilities to search and collection of information freely available to prisoners during the evening and on weekends.

2. Improvement of Open Prisons

We suggest that they might offer the incentives for temporary release to the prisoners of the open prison, where the temporary release rate should be more frequent than the general prison.
Concerning the use of open prison facilities, it is desirable to transfer the current low-use facilities inside each living room so that the inmates can use them freely in the evening or on the weekend, and to use outdoor sperm and benches. In addition, it is necessary to change the location of the current family reunion facilities located in the center of the prison, and to improve the time and method of using the home of family members.
In particular, we suggest to reduce the number of people who are sentenced to eight to nine times a day in an open prison, and to improve the method of personnel inspection so that they might be comfortable in the living room.
In addition, it is desirable to improve the independent walking of prisoners in an open facility.

3. Improvement of Somangui Jip(House of Hope)

We also suggest the Somangui Jip(House of Hope) to improve the inner facilities such as computer and Internet for the prisoner to enhance the information related ability and playgrounds in the front yard of the house of hope for the exercising. And providing their own cooking experiences shall be essential for them to manage basic life in the society.

4. Improvement of Hope Center

For the advancement of interim treatment, the establishment and operation of Hope Centers is priority need, for which providing incentives such as tax benefits for inmates and enterprises hiring the inmates would be helpful.
In regard of the function of the Hope Center, the policy need to be reconsidered that a person excluded from the parole review shall return to the main office to receive the lower level of treatment.
