“Achievements of Research in the field of Criminology and Criminal Justice for the past 30 years and Future Challenges (Ⅱ) - Research on Criminal Law” is an uation research report which analyzes the whole research on the criminal law conducted by the Korean Institute of Criminology for the last 30 years. Research on the criminal law as well as its direction has been changed developed continuously in accordance with changes in government policies and judicial reform. This research report reviewes achievement and outcomes of previous research on the criminal law and criminal justice policies as well as suggests future research directions.
By 2018, the KIC issued total 558 volumes of research reports covering criminal policies, the criminal substantive law, the criminal procedure law, special criminal acts, the international criminal law and so on. This research report classifies them into 5 categories - general criminal policy, amendment to the criminal law, the criminal law, the criminal procedure law, and the international criminal law and international cooperation- and 14 subcategories - trend of and uation on criminal policies, new paradigm of criminal justice, forensic science and criminal policy on risk management, the criminal law, the criminal procedure act, amendment to special criminal laws, criminal sanctions, individual crimes (Ⅰ).(Ⅱ).(Ⅲ).(Ⅳ), criminal justice agencies, criminal proceedings (Ⅰ).(Ⅱ), the international criminal law, and international cooperation. It reviews outcomes of research on respective areas with a view to uating not only achievements research on the criminal law and related fields but also limitations it faced.
Part Ⅰexamines a tendency of research on criminal law and related fields in relation to changes in government policies as well as criminal law theories for the past 30 years since the KIC was established. It also deals with research directions for discussion about special criminal law revision and then reviews results and challenges of overall research on the criminal law from the viewpoint of criminal jurisprudence.
Ⅱ reviews the research tendency on criminal policies as a practical field of the criminal law. It also assesses the new paradigm of criminal justice besides outcomes of research on forensic science and criminal policies on risk management.
Part Ⅲ outlines research tendency and results of studies on particulars of criminal law and criminal sanctions. Part Ⅳ provides outcomes of research on the criminal procedure act and criminal justice agencies with challenges it faces.
lastly, Part Ⅴ highlights international judicial assistance in criminal matters and implementation of international laws in Korea. Attention on those two fields has been growing due to globalization of crimes. It also provides achievements and issues regarding research on international criminal law and international cooperation on criminal matters.
