Abstract

1. Research Purpose

This study involves developing a law-related education program for North Korean defectors (LEPNK) with a aim to their mastering the basic legal knowledge necessary for living in a democratic society and promoting their legal consciousness and attitudes. The law-related education program for North Korean defectors (LEPNK) consists of providing legal knowledge with introductory cases where the legal issues are embedded that North Korean defectors confront in daily lives and thus preventing them against becoming offenders or victims for crimes in legally conflictual situations. Additionally, LEPNK intends to help North Korean defectors to overcome the differences in legal culture and emotion as well as legal knowledge arising from their past lives in North Korea.

2. Research Method

LEPNK is a two year (2010-2011) project that the development and implementation of the program is made in a two-step process. The first step involves conducting basic research such as literature review and in-depth interview for identifying North Korean defectors' needs for a law-related education that draw on their living conditions and determining the actual contents that consist of each module of a LEPNK teaching manual and a LEPNK workbook. The second step involves administering the developed program to North Korean youths and adults in the manner of a pilot test and revising the actual contents of the LEPNK teaching manual and workbook.
In-depth interview for North Korean defectors aimed for identifying their needs for the law-related education program and examining their level of legal consciousness. In-depth interview was made to two groups: North Korean Youth Defectors (n = 11) and North Korean Adult Defectors (n = 20).
North Korean Youth Defector group consisted of students and graduates of Hangyure Secondary School who were considered mainly self-expressive and thus were able to speak about the general situations of North Korean youth defectors as well as the problems relevant to their adjustment to South Korea. North Korean Adult Defector group consisted of the early settlers who lived in South Korea for 1 to 5 years and were presumed to be exposed to various legal conflicts and problems during their settlement. Additionally, adult group consisted of leaders of each group of Hanawon(Office for the Assistance of North Korean Defectors' Settlement) graduates who presumably knew about other North Korean defectors' living situations and their problems in adjustment to South Korea.
The main contents of the in-depth interview were the legal consciousness that were presumed to arise from the cultural differences between South Korea and North Korea and potential legal problems that might occur to North Korean defectors and might contribute to their being crime victims or making offenses. Data collected from the in-depth interview were analyzed by domain analysis and divided into mainly 4 domains that had several subdomains. Four domains were as follows: 1) Differences of legal system and culture between South Korea and North Korea 2) Common issues relevant to crime victimization 3) Common issues relevant to crime occurrence 4) Difference between Youths and Adults.

3. Overview of the Program(LEPNK)

1) Participants of the program

The potential participants of the LEPNK are North Korean youth and adult defectors. First, the LEPNK for Youth is mainly aimed for male and female students who attend middle or high schools and with adaptation, it can be extensively administered to elementary school students or college students. The LEPNK for Youth has been designed to be able to be used in regular schools, alternative schools, and afterschool programs. Second, the LEPNK for Adult is aimed for adults who receive settlement assistance in facilities such as Hanawon or Hana Center (Regional Office for the Assistance of North Korean Defectors' Settlement) where the law-related education program already exists. It can be used as the law-related education material for them in such places. Additionally the LEPNK for Adult can be used for general North Korean defectors who need re-education depending on their problems in settlement and thus can be used by social workers or professional counselors with specific modules of the program selected.
