Abstract

The research project of Comprehensive Policy for Developing Scientific Criminal Investigation and Forensic Science』led by Korean Institute of Criminology & Justice aims to build a national policy framework for scientific criminal investigation and forensic science in this era of the 4th Industrial Revolution.

Forensic science involves forensic theory and practive in criminal justice system, by applying scientific methods and processes to solving criminal matters. So this research consists of the digital forensic, bio forensic and forensic psychology, in the context of national scientific criminal investigation law and practice, based on co-research teams from Korean Association of Digital Forensic Studies, Korean Association of Forensic Psychology, Korean Society of Criminal Procedure Law, Korean Association of Criminal Case Law Studies, and Korean National Police University.

As the research project is to be proceed under the four main policy values of scientific investigation and forensic, such as human rights protection, effectiveness in investigation, national security & human safety, and criminal justice reform, this fourth year research of the 6 years-term project focuses on how scientific investigation and forensic science to contribute to the promtion of policy value, security, i.e. national security and human safety.

The value of 'security' in this year's research can be found in the fact that one of the main task of criminal investigation is to protect national security and human safety against any gross violations of security, including crimes against national security and social disaster. The technique developed by forensic science can be used to investigate the cause and effect of large-scale social disasters and to prevent any threats against national security. Security as a policy value can be realized by research and development, supporting institutions, and communication with experts and citizens. So does for the development of scientific criminal investigation and forensics. Model cases of scientific investigation and forensic in the cases of national security and human safety should be examined to back up the development of criminal investigation, and such development should be supported by legal instituions and policies. This will lead to more advanced national scientific criminal investigation and forensic policy in the coming era of digital transformation and the 4th Industrial Revolution.

The study of 2021 mainly consists of five parts with specific analysis of each research topics as follows:

Chapter 2 : The role of scientific criminal investigation for human safety
Chapter 3 : Review of case laws on national security from the point of scientific criminal investigation
Chapter 4 : Review of case laws on human safety from the point of scientific criminal investigation
Chapter 5 : Analysis of policies on scientific criminal investigation for national security and human safety

Part Ⅱ : Comparative review of the main legal tasks and policy issues of scientific criminal investigation for national security and human safety
Chapter 1 : Laws and cases of scientific criminal investigation for national security in the US, UK, Germany and Japan
Chapter 2 : Laws and cases of scientific criminal investigation for human safety in the US, UK, Germany and Japan
