1. Research Objective
This study aims to correct discrimination more effectively by supplementing existing laws on anti-discrimination and to enact laws that comprehensively address the widespread problem of discrimination.
2. Research Agenda
This research was promoted in five major directions. First, in order to enact general laws on equality or anti-discrimination, it is essential to analyze and derive international standards appearing in these international conventions, so we analyzed international standards on comprehensive prohibition of discrimination.
Second, we analyzed the equality or anti-discrimination laws of major countries such as the United States, the United Kingdom, Germany, and Canada at the time of enactment, not the current laws.
Third, in order to promote legislation, organizing key issues must be done first, so we analyzed key issues for comprehensive anti-discrimination legislation.
Fourth, an expert perception survey was conducted on legislative staff in the National Assembly, including members of the National Assembly, based on the main questions of the public perception survey conducted by the National Human Rights Commission of Korea in 2020 and additional questions related to law enactment.
Fifth, it was intended to provide complementary matters that legislative practitioners should consider when enacting general laws on equality and prohibition of discrimination.
3. Policy Suggestions
Referring to the results presented in this study, we propose to enact a general law on equality or anti-discrimination that can contribute to the guarantee of substantive freedom and equality and social integration in Korean society while responding to the requests of the international community.
