Abstract

□ Purpose of Research 


o The industrial accident rate in the construction industry is increasing continuously, and it is treated with greater seriousness, as the rate of judicial action against workplaces violating the Occupational Safety and Health Act in the construction industry is significantly higher than that of other industries. 


o Discussions on occupational safety and health crimes in the criminology and criminal policy fields have primarily focused on the punishment of criminal offenders under the law. Accordingly, empirical research on occupational safety and health crimes has been lacking from the victim's perspective. 


o This study is intended to produce basic data that can contribute to the development of policies to prevent, and support the victims of, occupational safety and health crimes in the construction industry by identifying the extent and characteristics of such crimes.


□ Research method 


o An examination was conducted of construction workers' awareness levels and experiences related to labor and their perceptions and experiences of victim related to occupational safety and health crimes through an personal interview survey of 1,000 construction workers. 


o The overall occupational safety and health conditions and characteristics of construction sites were explored through an in-depth interview of construction workers and safety and health management experts in the construction industry.


□ Results 


o One out of 10 construction workers had experienced physical victim such as injury while working at a construction site in which occupational safety and health measures were not properly observed. More than half of the workers had experienced physical victim had experienced two or more instances of victimization. 


o One out of five workers who had been victims of occupational safety and health crimes were likely to develop post-traumatic stress disorder. In rare cases, workers benefited from direct support for victim, including receiving explanations for the cause of victim. Despite the occurrence of occupational safety and health crimes involving bodily harm in workplaces where safety and health measures were not properly implemented, victimized workers complained that appropriate measures and compensation were not in place. 


o An exploration of the factors affecting the experience of occupational safety and health crimes victim with physical victim revealed that longer work experience was associated with a higher risk of being subjected to occupational safety and health crimes involving physical harm. Written employment contracts were associated with less risk than unwritten contracts. Higher worker satisfaction and a perception of higher employer compliance with occupational safety and health measures were associated with reduced risk.
